Lydia Gilpin, et al. to Lewis Massey & Elizabeth Massy Inry, January 4, 1790

January 4, 1790: Lewis Inry and Elizabeth (nee Massey) Inry of Kent County in Maryland buy for an additional 16 pounds, 2 shillings and 6 pence (over 68 pounds, 5 shillings, 6 pence already paid) for a 0.5 acre  parcel called Rich Leville (which Simon Wilmer once sold to Benjamin Dawes) from the heirs of  Thomas Gilpin (Sarah Massey had sold the land to Thomas Gilpin, who died before the transaction could be completed; afterwards Sarah Massey also died intestate, having born John Massey, who was lost at sea, and the aforesaid Elizabeth Massey, sole surviving heir) i.e., Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joshua Gilpin, collectively represented by William Tilghman, Esquire.  Witnesses: Samuel Crosby, Joseph Pryon, John Thomas, John Woodland, John Scott, and [illegible] Nicols.  Ben Chambers is Kent County Clerk.
This indenture made the thirteenth day of July in the year of our Lord one thousand seven hundred and eighty nine. Between Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joshua Gilpin, who survived [illegible] Fisher, executors of the last Will and Testament of Thomas Gilpin, late of the City of Philadelphia, deceased of the one part and Lewis Inry of Kent County, Maryland and Elizabeth his wife of the other part. Whereas the said Thomas Gilpin in his lifetime to wit, on the eighth day of November in the year of our Lord one thousand seven hundred and seventy three, by his certain bond or obligation under his hand and seal duly executed [illegible] bound unto Sarah Massey of the county aforesaid in the penal sum of [blank].  Conditions for the conveying and assuring unto the said Sarah Massey [illegible] for the lot of land hereinafter described and intended to be hereby granted and afterwards the said Thomas Gilpin died, having first made his last Will and Testament in writing whereby he gave his executors herein above named full power and authority to grant, bargain, sell, and convey all or any part of his real estate and whereas the said Sarah Massey afterwards died intestate, leaving issue two children, John who went to sea in the year one thousand seven hundred and twenty six and, never having been since heard of, is supposed to have perished, and Elizabeth now the wife of the said Lewis Inry and the said Lewis Inry hath paid to the said Lydia Gilpin, Thomas [illegible] Fisher, Samuel Rowland Fisher, Miers Fisher, and Joshua Gilpin the sum of sixteen pounds two shillings and six pence, being the balance of the purchase money remaining due for the said lot of ground and premises. Now therefore this indenture: Witnesseth that the said Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joshua Gilpin, in pursuance of the powers in them by the said Will vested in consideration as well of the sum of sixty eight pounds five shillings, six pence paid by the said Sarah Massey to the said Thomas Gilpin in his lifetime which is witnessed by endorsements on his conditions for the consideration money as of the sum of sixteen pounds two shillings and six pence to them in hand paid by the said Lewis Inry at this time of the execution hereof is hereby acknowledged and in discharge of the above recited bond of conveyance have and by these presents do grant, bargain, sell, alien, enfeoff, lease, and confirm unto the said Lewis Inry and Elizabeth his wife and the heirs of the said Elizabeth. All that messuage or tenement of land being part of a tract or parcel of land within which Benjamin Dawes purchased of a certain Simon Wilmer of the county aforesaid called Rich Leville, lying and being situated on the South side of Sassafras River in the county aforesaid at the head of the said river. Beginning at a locust post standing on the West side of the main road which passes or goes from Simon Willman Mill on the Herring Branch or run to Robert Lewis's mill at the head of Sassafras River and from the said post running on a range or parallel line with the front walk of the house wherein the said Benjamin Dawes now lives to wit: Nor sixty eight degrees West and nine perches, thence North two degrees East nine perches, thence South sixty eight degrees East nine perches, thence with the direct line to the place of beginning, containing and now laid out for half an acre of land, together with all and singular the buildings, improvements, woods, ways, water courses, rights, liberties, privileges, immunities, hereditaments, or appurtenances whatsoever to the same belonging and the revisions, remainders, rents, issues, and profits thereof and all the estate, right, title, and interest whatsoever in which the said Thomas Gilpin at the time of his death had of in into and out of the same area to have and to hold all and singular the premises hereby granted with the appurtenances to the said Lewis Inry and Elizabeth his wife and to the heirs of the said Elizabeth forever in trust. Nevertheless to and/or the use benefit and behoof of the right heirs of the said Sarah Massey, deceased, forever and the said Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joshua Gilpin do hereby constitute and appoint William Tilghman, of Kent County aforesaid, Esquire, their true and lawful attorney to appear before any court or any magistrate having cognizance of the acknowledgement of deeds and acknowledged the above as their and each of their acts and deed in witness whereof the said parties have hereunto interchangeably set their hands and seals the day and year first above written.

Kent County Maryland aforesaid.  On the thirty first day of October anno Domini one thousand seven hundred and eighty nine personally became came before us, the subscribers, two of the Justices of the Peace for the County of Kent in Maryland, Samuel Crosby, one of the subscribing witnesses to the above written indenture and on his solemn oath did testify and declare that he was personally present and did see Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joseph Gilpin severally sign, seal, execute, and deliver the above written indenture and power of attorney therein mentioned as their act and deed to and for the uses therein mentioned and that he the said Samuel Crosby together with Joseph Pryon did in the presence of each other sign  their names as witnesses thereto. Witness our hands and seals the day and year aforesaid.

Kent County aforesaid.  On the eleventh day of January in the year of our Lord seventeen hundred and twenty before us, the subscribers, two of the Justices of the Peace for Kent County, personally appeared William Tilghman of Chester Town in Kent County and by virtue of the power in the within written indenture to him given acknowledged the within written indenture as the act and deed of Lydia Gilpin, Thomas Fisher, Samuel Rowland Fisher, Miers Fisher, and Joseph Gilpin and of each of them. Witness our hands the day and year aforesaid.
