Robert Smith to Nicholas Massey, March 16, 1693


March 16, 1693: Nicholas Massey of Talbot County in Maryland for 4,500 pounds of tobacco buys a 150 acre parcel called Malton from Robert Smith and wife Anne.  Witness: Richard Simon and [illegible signature].
This indenture made the sixteenth day of March in the year of our Lord God one thousand six hundred and ninety and three made between Robert Smith, his heirs, executors, administrators, of the one part and Nicholas Massey, his heirs, or his assigns, of the other part. Witnesseth that the said Robert Smith for and in consideration of the sum of four thousand five hundred pounds of tobacco to him in hand paid at and before the sealing and delivery here of the receipt whereof he does hereby acknowledge and himself therewith and of [illegible] part and parcel thereof fully satisfied, contented, and paid and do by these presents exonerate, acquit, and discharge the said Nicholas Massey, his heirs, executors, administrators, and [illegible] of them by these presents forever and for diverse good causes and considerations him thereunto more especially [illegible] have given and granted and by these presents doth give, grant, bargain, sell, alienate, enfeoff, and confirm from him and his heirs forever unto him this said Nicholas Massey, his heirs, or his assigns, forever all that parcel of land being part of a tract of land called Malton, situate on Chester River in Talbot County butted and bounded first beginning at a marked oak by great branch running North East sixty perches to another oak by a [marsh] then South East by the river thirty perches to a tree with four notches thence South South East [illegible] South ninety perches to a marked pine tree then South two hundred and eighty perches then East by South sixty perches then North two hundred and eighty perches to the river and by the river to the pine tree containing an hundred and fifty acres more or less.  To have and to hold the aforesaid parcel of land together with all and singular the rights, profits, privileges, and benefits thereunto belonging, Royal mines excepted. Unto him the said Nicholas Massey, his heirs, or his assigns, forever and further the said Robert Smith does for himself and his heirs covenant and agree to and with the said Nicholas Massey, his heirs, or his assigns, that the aforesaid bargained premises with the appurtenances [crossed out words] now are by virtue of these presents the free and [illegible] estate in fee simple of him the said Nicholas, his heirs, and assigns, forever and after all the estate, right, title, interest, claim, and demand which he the said Robert now have made might be or of right ought to have in of or to the aforesaid bargained premises with the appurtenances as hereby fully, clearly, and absolutely released and invested in and upon the said Nicholas Massey, his heirs, or his assigns, forever to his and their only proper use and behoof forever free and clear and freely and [illegible] acquitted [illegible] and discharged of and from all other and former gifts, grants, bargains, sales, leases, forfeitures, jointures, surrenders, judgments, executions, use rents, and arrearages of rents and services grown due and payable to the Chief Lord or Lords of the fee or fees [illegible] and [illegible] seized and from all other encumbrances whatsoever he the said Robert Smith and his heirs against all manner of persons whatsoever lawfully claiming shall and will forever warrant and defend and him the said Nicholas, his heirs, and assigns, in peaceable possession to maintain and further [illegible] the said Robert doth hereby covenant for himself and his heirs all the reasonable request of the said Nicholas Massey, his heirs or his assigns at any time within the space of seven years now [illegible] on having to make any further assurance as he the said Nicholas Massey, his heirs, and assigns,his or their counsel learned in the law shall reasonably advise, devise, and require at the proper costs and charges in law of him the said Nicholas Massey, his heirs, and assigns.  In witness whereof we the parties to these presents have interchangeably and set to their hands and affixed their seals the day and year first above written.
