Benjamin Massey to Benoni Harris, February 15, 1796


February 15, 1796: Benoni Harris of Kent County in Maryland for 6,200 pounds of tobacco buys a tract of land called Reviving Springs (which Eleazer Massey purchased from Samuel Ridgeway, Esq. and wife Littilia, and deeded to Sarah (nee Harris) Massey, now the wife of Benoni Harris, and Elizabeth Massey)  from Benjamin Massey, gentleman, and wife Elizabeth Massey.  Witnesses: T. Roberts and Dan. Knock.
Queen Anne's County to wit: On the 16th day of February, seventeen hundred and ninety six the following deed was brought to be recorded as follows to wit:

This indenture made this nineteenth day of August in the year of our Lord one thousand seven hundred and ninety two. Between Benjamin Massey of Kent County, State of Maryland, gentlemen and Elizabeth, his wife of the one part, and Benoni Harris of Kent County, State of Delaware of the other part; witnesseth that the said Benjamin Massey and Elizabeth his wife for and in consideration of the sum of five hundred and eighty three pounds six shillings and eight pence lawful current money of Maryland to them in hand paid by the said Benoni Harris, have granted, bargained, sold, aliened, remised, released, enfeoffed, conveyed, and confirmed, and by these presents the said Benjamin Massey and Elizabeth his wife to grant, bargain, sell, alien, remise, release, enfeoff, convey, and confirm unto the said Benoni Harris, his heirs, and assigns, forever all and singular their right, title, and estate which they the said Benjamin Massey and Elizabeth his wife or either of them hath in and to a certain part of a tract of land called and known by the name of Reviving Springs lying and being in Queen Anne's County and State of Maryland aforesaid which Eleazer Massey, father of the said Elizabeth Massey, the wife of Benjamin Massey aforesaid formerly purchased of Samuel Ridgeway Esquire, deceased, and Littilia, his wife, did on the eighth day of September in the year of our Lord one thousand seven hundred and eighty seven, granted by a deed onto his two daughters Sarah Massey Elizabeth Massey being the undivided estate of said Sarah Massey (now Sarah Harris, the wife of said Benoni Harris) and the aforesaid Elizabeth Massey. Now be it known that the said Benjamin Massey and Elizabeth his wife, for and in consideration of the sum of money above-mentioned have sold and confirmed unto the above-named Benoni Harris, his heirs, and assigns, forever, all their right, title, claim, and demand of and into the above described lands and premises which they, the said Benjamin Massey and Elizabeth his wife, their or either of their heirs, now have either in law or equity with all and singular the houses, outhouses, stables, barns, orchards, woods, underwoods, ways, profits, and hereditaments whatsoever to the land belonging or in anywise appertaining thereto.  To have and to hold the said lands and premises with every part and parcel thereof to him the said Benoni Harris, his heirs, and assigns, to the only proper use and behoof him the said Benoni Harris [and] his heirs forever and the said Benjamin Massey and Elizabeth his wife for themselves, their heirs, executors, and administrators, doth covenant, grant, and agree to and with the said Benoni Harris, his heirs, and assigns, that they the said Benjamin Massey and Elizabeth, his wife, their heirs and either of their heirs the aforesaid lands and premises against all and all manner of persons or persons whatsoever claiming or to claim the same by from or under him them or any of them, shall will well and truly warrant and forever defend. In witness whereof the said Benjamin Massey and Elizabeth his wife have hereunto set their hands and seals the day and year first above written.

On the back of the same deed was endorsed as following to wit.:
Queen Anne's County.  Be it remembered that on the nineteenth day of August seventeen hundred and ninety five personally appeared Benjamin Massey before us, two of the Justices of the Peace for said County and did acknowledge the within to be his act and deed and the lands and premises thereon mentioned to be the right and estate of Benoni Harris, his heirs, and assigns, and at the same time personally appeared Elizabeth Massey, wife of the said Benjamin, and she being by us privately examined out of the hearing of her husband did declare that she made her acknowledgment freely and willingly and without being induced thereto by fear or threats of her said husband or for fear of his displeasure and that the lands and premises therein mentioned to be the right and estate of the said Benoni Harris, his heirs, and assigns, forever according to the true intent and meaning of the same deed

Received [on] the day of the date of the within deed from Benoni Harris and Sarah his wife the sum of five hundred and eighty three pounds five shillings and eight pence, it being in full for the consideration of the within.
