Richard Jefferys to Eleazer Massey, July 13, 1774


July 13, 1774:   Eleazer Massey of Queen Anne's County in Maryland leases for 50 pounds (for a 7-year term) from Richard Jeffreys (free Negro, formerly tenant to John Wilson of Kent County) a 73-acre tract of land called Killmanors Plains.  Witness: Nachel Downes.
Queen Anne's County to wit: July the thirteenth Anno Domini seventeen hundred and seventy four the following deed was brought to be recorded.
This Indenture made the twenty seventh day of June in the year of our Lord seventeen hundred and seventy four between Richard Jefferys of Queen Anne's County in the province of Maryland, free Negro, formally tenant to John Wilson of Kent County in the province aforesaid of the one part and Eleazer Massey of the same place, planter of the other part. Witnesseth that the said Richard Jefferys for and in consideration of the sum of fifty pounds current money to him in hand paid by the said Eleazer Massey at or before the sealing and delivery of these presents, the receipt whereof he the said Richard Jefferys doth freely acknowledge, hath granted, bargained, and sold unto and by these presents does grant, bargain, and sell onto the said Eleazer Massey, his executors, administrators, and assigns, all that part of a tract of land called Killmanors Plains lying and being in Queen Anne's County aforesaid on a branch of Chester River called the Unicorn Branch which is now the right estate and property of him the said Richard Jefferys containing by estimation seventy three acres of land and also the reversion and reversions, remainder and remainders, rent, issues, and profits of all and singular the said premises and every part and parcel thereof of with the appurtenances. To have and to hold the said land and premises with the appurtenances unto the said Eleazer Massey, his executors, administrators, and assigns, from the day before the date of these presents for and during the term of seven years fully to be complete and ended, yielding and paying therefore yearly during the said term at or upon the first day of July one peppercorn if demanded, provided and these presents are upon this condition and it is the true intent and meaning thereof and of the said parties hereunto that if the said Richard Jefferys his heirs or assigns do and shall well and truly pay or cause to be paid unto the said Eliezer Massey his heirs or assigns the full sum of fifty pounds current money with legal interest for the same or before the first day of July which shall be in the year seventeen hundred and seventy eight without any deduction, defalcation, or abatement whatsoever, that then and from thenceforth their presents and every matter and thing herein contained shall cease, determine, and be utterly null and void to all intents and purposes, anything herein contained to the contrary thereof, in any wise notwithstanding.  And the said Richard Jefferys for himself, his heirs, executors, and administrators, doth covenant, promise, grant, and agree to and with the said Eleazer Massey, his executors, administrators, and assigns, that he the said Richard Jefferys, his heirs, executors, or administrrators, shall and will well and truly pay or cause to be paid unto the said Eleazer Massey, his executors, administrators, or assigns, the said sum of fifty pounds current money with legal interest for the same on or before the said first day of July seventeen hundred and seventy eight without any deduction as aforesaid according to the true intent and meaning of these presents. And also that he the said Eleazer Massey, his executors, administrators, and assigns, shall and may at all times after default shall be made in payment of the said sum of fifty pounds and interest thereon or any part thereof at the time herein before invited for payment thereof peaceably and quietly, have, hold, occupy, possess, and enjoy all and singular this lands and premises aforesaid granted, bargained, and sold, or mentioned or intended so to be, with the appurtenances as aforesaid for and during all the rest, residue and remainder of the said term of seven years which shall be then to come and unsecured without the set, suit, hindrance, molestation, interruption, or eviction of him the said Richard Jefferys, his heirs and assigns, or of any other person or persons whatsoever lawfully claiming or to claim by from under him or them or any of them and further that he the said Richard Jefferys and his heirs and all and every other person and persons having or lawfully claiming any right, title, or interest in or to the said premises or any part or parcel thereof by, from, or under him or them, shall and will after default shall be made in payment of the said sum of fifty pounds and interest thereon are any part thereof as aforesaid make do and execute or cause or [illegible] to be made done and executed all and every such further and other lawful and reasonable act and acts.  Thing and things, assurance and assurances, in the law whatsoever, for the further, better and more perfect granting and assuring of all and singular the said premises with the appurtenances above bargained and sold or mentioned or intended so to be made onto said Eleazer Massey, his executors, administrators, and assigns, for and during all the residue and remainder of the said term of seven years above granted or by the said Eleazer Massey, his executors, administrators, or assigns, or his or their counsel learned in the law shall be reasonably advised or required.  And lastly it is covenanted, granted, concluded, and agreed upon by and between the said parties to these presents and the true intent and meaning hereof is and it is hereby declared to be that until default shall be made in payment of the said sum of fifty pounds and interest thereon or any part thereof as aforesaid it shall and may be lawful to and for the said Richard Jefferys, his heirs, and assigns, to have hold and enjoy all and singular the said premises with the appurtenances above bargained and sold in manner aforesaid and to receive and take the rents, issues, and profits thereof to him and their own proper use and benefit, anything herein contained to the contrary thereof in any wise notwithstanding. In witness thereof the parties aforesaid have hereto interchangeably set their hands and seals the day of year first above written.  The words, "of land" being first interlined.

Be it remembered that on the day of the date of the within indenture Richard Jefferys the mortgagor within mentioned personally appeared before me the subscriber one of his His Lordship's Justices of the Peace for Queen Anne's County and did acknowledge the within indenture to be his act and deed and the lands and premises therein mentioned to be the right and estate of Eleazer Massey the mortgagee within mentioned his heirs and assigns according to the true intent and meaning thereof
