William Price & wife Sarah to David Witherspoon: Deed dated December 20, 1753

 
December 20, 1753: David Witherspoon of Newcastle County buys a 319 acre portion of Angels Rest for £200 from William Price, joiner, initially of Talbot County but lately of Dorchester County in Maryland.  Courses: Beginning at the end of the second line of Angels Rest and running thence East four hundred and twenty perches, then North one hundred and twenty perches, then West four hundred and twenty perches, and then with a straight line to the beginning. Acting for the Crown: Justices of the Peace Bedingfield Hands and C. Whichcote; also Sam. Toney and W. Hynson; acting as witnesses: James Tilghman and John Williamson; James Smith is Kent County clerk.
 
This indenture made twenty first day of June in the year of our Lord one thousand seven hundred and fifty three between William Price lately of Talbot but now of Dorchester County, joiner of the one part and David Witherspoon of New Castle County on Delaware of the other part. Witnesseth that the said William for and in consideration of two hundred pounds current money of Maryland to him in hand paid by the said David Witherspoon at the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge hath given granted bargained and sold aliened released enfeoffed and confirmed and by these presents for himself and his heirs do clearly and absolutely give grand bargain sell alien release enfeoff and confirm unto the said David Witherspoon his heirs and assigns forever all that part of a tract of land called Angels Rest lying in Kent County in the Province of Maryland which is contained within the following lines to wit: Beginning of at the end of the second line of the same tract and running from thence East four hundred twenty perches then North one hundred twenty perches then West four hundred twenty purges and then with a straight line to the place of beginning containing three hundred ninety acres more or less together with all trees woods underwoods commons common of pasture profits commodities advantages emoluments hereditaments whatsoever to the premises belonging or in any wise appertaining or in or upon the same growing happening or arising and also the reversion and reversions remainder and remainders rents and services of the premises and every part and parcel of them and all the estate right title interest claim and demand whatsoever of him the said William of in or to the premises with the appurtenances in every parcel and part of them to have and to hold the bargain and sold premises and every part and parcel of them with the appurtenances to the said David Witherspoon his heirs and assigns to the only proper use and behoof of the said David Witherspoon his heirs and assigns forever and he the said William Price for himself and his heirs doth hereby covenant grant and agree to and with the said David Witherspoon his heirs and assigns forever that he the same William now at the time of the sealing and delivery of these presents hath in himself the rightful power and lawful authority to grant bargain and sell the aforesaid bargained and sold premises with the appurtenances to the said David Witherspoon his heirs and assigns in manner and form aforesaid and that the same premises with appurtenances are absolutely free clear and discharged of all and all manner of encumbrances by him the said William heretofore had made or suffered or caused or [illegible] to be had made or suffered and the said William doth for himself and his heirs executors and administrators further warrant grant and agree to and with the said David Witherspoon his heirs executors and administrators that Sarah now the wife of the said William within five months from the date of these presence in due form of law acknowledge this deed before some two justices of the peace for Kent County aforesaid so that she may be effectually barred and excluded from her dower in the bargained and sold premises in every part and parcel thereof. In witness whereof the parties to these presents have thereon to put their hands and seals interchangeably the day and year above written.

Kent County [illegible] June 21, 1753: Then the within named William Price personally acknowledged the within deed and all the lands and premises with the appurtenances thereby granted bargained and sold to the within named David Witherspoon his heirs and assigns to the only proper use of the who for the said David Witherspoon his heirs and assigns forever according to the form and effect of the same deed before us the subscribers two of his Lordship's justices of the peace for the county aforesaid.

Received June 21, 1753 from David Witherspoon two hundred pounds current money in full consideration for the within granted land and premises received by me:

Kent County [illegible] August 26, 1753: Then appeared before us the subscribers two of his Lordship's justices of the peace for the county aforesaid Sarah the wife of the within named William Price and being by us privately examined out of the hearing ever said husband did acknowledge the within granted land premises and appurtenances thereto belonging to be the right title interest property and estate of the within named David Witherspoon his heirs and assigns forever and that she made this acknowledgment willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure.
