Benjamin Massey to Joshua M. Massey, January 16, 1823

August 7, 1822 (Recorded January 16, 1823): Joshua W. Massey of Queen Anne's County in Maryland for $3,996.00 buys the combined 154 acres of portions of the parcels, Angel's Rest, Angel's Lot, Partnership, and Spring Garden (all lying in Kent County) from Benjamin Massey of Kent County.  Witnesses: Edward Eubanks and John McDaniel, Justices of the Peace for Kent County. [Kent County, Maryland] Be it remembered that on the sixteenth day of January eighteen hundred and twenty three a deed was brought to be enrolled among the land records of Kent County, the tenor whereof here ensues in the following words to wit: This indenture was made the seventh day of August in the year eighteen hundred and twenty two between Benjamin Massey of Kent County and State of Maryland of the one part and Joshua W. Massey of Queen Anne's County and state aforesaid of the other part. Witnesseth that the said Benjamin Massey of and in consideration of the sum of three thousand nine hundred and ninety six dollars current money of the United States to him in hand paid by the said Joshua W. Massey before the sealing and delivery of these presents, the receipt whereof he, the said Benjamin Massey, doth freely acknowledge and [illegible] every part and parcel thereof doth freely acquit, exonerate, and discharge the said Joshua W. Massey. his heirs executors, and assigns, he, the said Benjamin Massey, has granted, bargained, and sold, enfeoffed, and confirmed and by these presents doth grant, bargain, sell, enfeoff, and confirm unto the said Joshua W. Massey, his heirs and assigns, part of those several tracts or parcels of land situate lying and being in Kent County and State of Maryland which are called and known by the following names to wit: Part of a tract of land called Angels Rest, part of a tract of land called Angels Lot, part of a tract of land called Partnership, and part of the tract of land called Spring Garden; said several parts and parcels of land are contained within the following described lines and bounds: Beginning at the end of the third line of Angels Rest and running thence South fifty one and one quarter degrees West three hundred and thirty two perches until it intersects the eleventh line of the survey made by Thomas Gale for Benjamin Massey, thence with said survey South eighty one degrees East ninety four perches, thence South seventy five degrees East sixty and one quarter perches, thence North twenty six and one quarter degrees East fourteen and one fourth perches, thence South seventy three degrees East twelve and four fifths perches, then North twenty eight degrees East one hundred and eighty one and one half perches and North thirty four degrees East sixty five and one quarter perches, thence to the beginning North fifty nine degrees West thirty five and one sixteenth part of a perch, containing and now laid out for one hundred and fifty four acres and six perches of land, be the same more or less, together with all and singular the houses, outhouse, buildings, gardens, orchards, improvements to the said several parcels of land hereby granted bargained and sold, each and every of them belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and services of the same, and that each and every of them and all the estate, right, title, interest, property, claim, and demand, both in law and equity, which said Benjamin Massey may or can have of him and to the several parcels of land hereby granted, and each and every of them and every part thereof. To have and to hold all and singular the above granted lands and premises and each and every of them with their appurtenances to the said Joshua W. Massey, his heirs and assigns, to his and their own proper use and behoof forever, and the said Benjamin Massey, for himself, his heirs, executors, and administrators, doth hereby covenant, promise, and agree to and with the said Joshua W. Massey, his heirs, executors, administrators, and assigns, that he, the said Benjamin Massey and his heirs, and all persons claiming under him or them shall and will at all times hereafter at the reasonable request and at the proper cost in the law of him, the said Joshua W. Massey, his heirs or assigns, make, do, execute, and suffer, or cause to be made, done, executed, and suffered such further and other acts and acts, deed and deeds, thing and things, assurance and assurances, for the firmly and more effectual assurance and conveyance of the several parcels of land and each and every of them hereby bargained and sold with their and each of their [illegible] and perchess to the said Joshua W. Massey, his heirs and assigns, according to the true intent and meaning of this indenture as shall be by said Joshua W. Massey, his heirs or assigns, or his or their counsel learned in the law from time to time [illegible phrase] I have hereunto set my hand and seal the day and year above written.

Maryland, Kent County: On this seventh day of August in the year of our Lord one thousand eight hundred and twenty two personally appeared Benjamin Massey of the county and state aforesaid, being the party grantor above named, before us, two of the Justices of the Peace for the county and state aforesaid, and did acknowledge the within deed or instrument of writing to be his act and deed and the lands and premises therein mentioned and thereby bargained and sold to be the right and estate of the within named Joshua W. Massey, his heirs and assigns forever according to purport, true intent, and meaning of the said deed or instrument of writing and the acts of assembly in such cases made and provided; and now at the same time also appeared Elizabeth Massey, wife of said Benjamin Massey, before us, the subscribers two of the Justices of the Peace for the county and state aforesaid, and acknowledged the said deed or instrument of writing to be her act and deed and the lands and premises therein herein mentioned to be the right and estate of the within mentioned Joshua W. Massey, his heirs and assigns, forever and the said Elizabeth Massey, being by us privately examined apart from and out of the hearing of her husband whether she does make her acknowledgment of the same willingly and freely and without being induced thereto by fear or threats of ill usage of her husband or fear of his displeasure acknowledged that she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of ill usage by her husband or fear of his displeasure.  Taken and certified the day and year above written.
