Benjamin Massey from Cornelius Comegys, January 18, 1817

January 18, 1817: Benjamin Massey, Esquire, of Kent County in Maryland buys and holds in trust for Nathaniel Comegys, "true person of color," of Kent County a five acre parcel, part of tract called Partnership in Kent County that was sold by Philip Reed, Esquire, acting as trustee for the estate of William Clark, to Cornelius Comegys, and for which a deed of sale had been drawn up with Nathaniel but for which Nathaniel had been unable to pay.  Benjamin and Nathaniel came to an understanding wherein Benjamin would enter into a new indenture and purchase the parcel for $35.00, which Benjamin completed on the same day.  Witnesses: Justices of the Peace William Redding and James Salisbury; William Scott is Kent County clerk.

[Kent County, Maryland] Be it remembered that on the eighteenth day of January, eighteen hundred and seventeen, a deed was brought to be enrolled among the land records of Kent County, the tenor whereof here ensues in the following words to wit: This indenture or deed of bargain and sale made this eighteenth day of January in the year of our Lord eighteen hundred and seventeen between Cornelius Comegys of Kent County in the state of Maryland of the one part and Benjamin Massey, Esquire, of the county and state of Maryland beforesaid of the other part. Witness that whereas Nathaniel Comegys, so-called true person of color of the county aforesaid, did some years past and gave agreed to and with the said Cornelius Comegys five acres of land being a part of a tract of land called Partnership in the county aforesaid and the very same which Philip Reed, Esquire, or trustee for the heirs of William Clark, late of Kent County, deceased, sold unto the said Cornelius Comegys and by the said Cornelius Comegys to the said Nathaniel and the said Nathaniel not paying the purchase money for the several years that deed was accordingly unattached from him the said Nathaniel of the said 5 acres of land and the said Nathaniel having agreed to and with the said Benjamin Massey, Esquire, for the said 5 acres of land request of him the said Cornelius Comegys in order to save expense that he the said Cornelius Comegys should make over, transfer, and convey to the said Benjamin Massey, Esquire, all right, title, claim, interest, and demand whatsoever of him, the said Cornelius Comegys, or of him the said Nathaniel, of in and to the aforesaid five acres of land. Now therefore this indenture or deed more fully witnesseth that in consideration of the provisos and in consideration of thirty five dollars money of the United States to him, the said Cornelius Comegys, in hand paid by the said Benjamin Massey, Esquire, in trust and for the use of the said Nathaniel, the receipt whereof he, the said Cornelius Comegys, doth hereby acknowledge and doth exonerate, acquit, and forever discharge him, the said Benjamin Massey, his heirs and assigns, forever hath granted bargained sold aliened enfeoffed conveyed and confirmed and by this instrument of writing doth grant, bargain, sell, alien, enfeoff, convey, and confirm unto the said Benjamin Massey the aforesaid five acres of land to him, his heirs and assigns, forever together with all and singular the rights [illegible], hereditaments, and appurtenances whatsoever thereunto belonging or in any wise appertaining with the reversion and reversions, remainder and remainders, rents, issues, and profits thereof with all the estate of him, said Cornelius Comegys and his heirs. To have and to hold onto the said Benjamin Massey the said hereby granted, bargained, and sold five acres of land and premises and every part and parcel thereof to the only proper use and behoof of him, the said Benjamin Massey, his heirs and assigns, forever and for no other use or purpose whatsoever. In witness whereof the said Cornelius Comegys hath hereunto set his hand and affixed his seal the day and year first written.

Kent County state of Maryland to wit: be it remembered that on the day of the date of the written and foregoing instrument of writing personally appeared Cornelius
Comegys before us, the subscribers, two of the Justices of the Peace for Kent County in the state of Maryland aforesaid, and did acknowledge the said instrument of writing to be his act and deed for the uses and purposes therein mentioned.
