Casparis Meginnis to Benjamin Massey, July 24, 1812

July 24, 1812 (recorded December 7, 1812): Benjamin Massey of Kent County in Maryland finalizes his purchase (initiated August 19, 1805) of a tract of land called Partnership from Casparis Meginnis and wife Martha, also of Kent County, who hereby release the associated mortgage on the property.  Witnesses: Justices of the Peace Ephraim Vansant and Cornelius Comegys; Ben Chambers is Kent County Clerk.

Kent County aforesaid: Be it remembered that on the seventh day of September in the year of our Lord one thousand eight hundred and twelve the following release of mortgage was brought to be enrolled among the records of Kent County of the tenor and in the words following to wit: This indenture, made this twenty-fourth day of July in the year of our Lord one thousand eight hundred and twelve, between Casparis Meginnis of Kent County in the state of Maryland of the one part and Benjamin Massey of the same county and state of the other part. Witnesseth that whereas the said Benjamin Massey did heretofore by deed bearing date the nineteenth day of August in the year one thousand eight hundred and five, duly executed and recorded amongst the land records of Kent County, conveyed to the said Casparis Meginnis part of a tract of land lying and being in said county called Partnership by way of mortgage for the securing and limiting the sum of money in the said deed mentioned, and whereas the principal sum with the interest thereon which was so limited and secured by the said deed has been paid to the said Carparis Meginnis by the said Benjamin Massey.

Now this indenture: Witnesseth that for and in consideration of the premises recited and of the said sum of money paid to the said Casparis Meginnis, receipt whereof he doth hereby acknowledge, he, the said Casparis Meginnis, hath granted, bargained, sold, released, and confirmed and by these presents doth grant, bargain, and sell, release, and confirm unto the said Benjamin Massey, his heirs, and assigns, all that land conveyed to the said Casparis Meginnis by the above-mentioned deed and all the estate, right, title, and interest whatsoever of him, the said Casparis Meginnis, both at law and in equity of in to and out of the same and every part and parcel thereof. To have and to hold the said part or parts of a tract or parcel of land so as aforesaid described called Partnership or by whatsoever name the same may be called, together with the appurtenances thereunto belonging, unto the said Benjamin Massey, his heirs, and assigns, forever the only proper use and behoof of the said Benjamin Massey, his heirs, and assigns, forever and to and for no other use, intent, or purpose. In witness whereof the said Casparis Meginnis hath hereunto subscribed his name and affixed his seal the day and year first wherein above written.

Maryland Kent County aforesaid: Be it remembered that on this twenty-fourth day of July in the year of our Lord one thousand eight hundred and twelve personally appeared Casparis Meginnis of Kent County, the party grantor within named, before us, the subscribers, two of the Justices of the Peace of the said state for said county, and he knowledged the within deed or instrument of writing to be his act and deed and the lands and premises therein mentioned to be the right and estate of the within named Benjamin Massey, his heirs, and assigns, according to the purport, true intent, and meaning of the said deed and now at the same time also appeared personally Martha Meginnis, wife of the said Casparis Meginnis, before us, Justices of the Peace as aforesaid, and acknowledged the said deed or instrument of writing to be her act and deed and the lands and premises therein mentioned to be the right and estate of the within named Benjamin Massey, his heirs, and assigns, forever and the said Martha Meginnis, being by us privately examined apart from and out of the hearing of her husband whether she doth make her acknowledgment of the same willingly and freely and without being induced thereto by fear of or threats of ill usage by her husband or fear of his displeasure, acknowledged and declared that she doth make her acknowledgment of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure.  Taken and certified the day and year above written.
