Nicholas Massey, patent, July 8, 1702


July 8, 1702: Nicholas Massey's patent of Massey's Hazard, a 90 acre portion of a 1,000 acre tract granted to Daniel Toaos [Toaes] in Kent County, Maryland.
Acting for the Crown: Henry Darnell.

Charles etc. to all persons etc. Know ye that for and in consideration of Nicholas Massey of Kent County in our said province of Maryland has onto him 90 acres of land within our said province being due onto him by assignment of that quantity from Daniel Toaos out of a warrant for one thousand acres granted him the twenty second day of May one thousand seven hundred as appears in our land office and upon such conditions and terms as our [illegible] in our conditions of plantations of our said province bearing the twenty fifth day of April one thousand six hundred and eighty four and remaining upon record in our said province of Maryland together with such alterations as in [illegible] made by our further conditions bearing date the fourth day of December one thousand six hundred and ninety six and registered in our land office of our said province. We do therefore hereby grant unto him the said Nicholas Massey all that tract or parcel of land called Massey's Hazard situate lying and being in Kent County and the [illegible] side of the [illegible] [illegible] of the Worship Branch of a branch of Chester River called the Unicorn Branch beginning at an old boundary white oak being the first boundary of a tract of land formally taken up by Simon Whittmor containing one thousand acres and running from said tree South three hundred and sixty [illegible] [illegible] [illegible] ahead of the aforesaid branch [illegible] down the [illegible] branch on its illegible courses viz. North fifty two degrees West twenty nine [illegible] North thirty [illegible] North sixteen degrees thirty minutes [illegible] forty eight [illegible] North thirty three degrees thirty minutes, East twenty [illegible] North sixteen degrees, West ninety eight [illegible], North seventy nine perches, North thirty four degrees thirty minutes, [illegible] seventy nine perches, then with a straight line to the first marked tree containing and now laid out for ninety acres more or less according to the certificate of survey thereof taken and returned into our land office bearing date the eighteenth day of July one thousand seven hundred and [illegible] remaining together with all rights, profits, benefits, and [illegible] thereunto belonging (Royal mines excepted) to have and to hold onto him the said Nicholas Massey, his heirs and assigns, forever and to beholden of us and our heirs as of our mannor of Baltemore in free and common [illegible] by [illegible] only for all manner of [illegible] yielding and paying therefore yearly unto us and our heirs at our receipt at the city of St. Maries at the two most usual feasts in the year, viz.the Feast of the Annunciation of the Blessed Virgin Mary and of St. Michael the Archangel by even and equal portions the rent of three shillings and five pence sterling in silver or gold and for a fine upon every alienation of the said land or any part or parcel thereof one whole year's rent in silver or gold on the full value thereof in such commodity or commodities as we and our heirs or such officer or officers as shall be appointed by us and our heirs for time to time to collect and receive the same shall accept in discharge thereof at the choice of us and our heirs or such officer or officers as aforesaid provided that if the said sum for a fine for alienation shall not be paid to us and our heirs or such officer or officers as aforesaid before such alienation and the said alienations entered upon record other in the Prvincial Court or in the County Court in which the same land lyeth within one month next after such alienation the said alienation shall be void and of no effect.  Given under our greater seal at arms the eighth day of July one thousand seven hundred and five. Witness our trusty and well beloved Chancellor Henry Darnell keeper of our greater seal in our said province of Maryland.
