Catharine Massey and Nicholas Massey to Joseph Massey, October 9, 1765

October 9, 1765: Joseph Massey, farmer of Kent County, buys for £200 a 100 acre tract called Partnership from Catharine Massey, spinster, and Nicholas Massey, farmer, and Henrietta, his wife, also of Kent County.   Witnesses: James MacLachlan and Samuel Thompson.  Acting for the Crown: Mssrs. MacLachlan, Thompson and Nicholson; Kent County Clerk is Daniel Dulany.

This indenture made this ninth day of October in the year of our Lord one thousand seven hundred and sixty five. Between Catharine Massey of Kent County in the province of Maryland, spinster, and Nicholas Massey of the county and province aforesaid, farmer of the one part and Joseph Massey of the said county and province, farmer of the other part. Witnesseth that the said Catharine Massey and Nicholas Massey for and in consideration of the sum of two hundred pounds current money to them in hand paid by the said Joseph Massey before the ensealing and delivery of these presents the receipt whereof they do hereby acknowledge, they the said Catharine Massey and Nicholas Massey have granted, bargained, and sold, aliened, and confirmed, and by these presents doth grant, bargain, sell, alien, and confirm unto the said Joseph Massey, his heirs, and assigns, forever all that part of a tract or parcel of land lying in the county aforesaid called Partnership which is contained in the following boundaries and courses to wit: beginning at a small Spanish oak marked with nine notches standing near the head of a drain that proceeds out of a branch called Pudding Branch running North two hundred and forty eight  perches and South thirty one degrees West one hundred and eight perches thence South twenty two degrees West forty two perches and South fourteen degrees West one hundred and twenty four perches thence with a straight line to the beginning tree containing 100 acres more or less and also all lands, trees, woods, underwoods, profits, commodities, and appurtenances whatsoever to the said messuage or tenement and premises above-mentioned belonging or in any wise appertaining and also the reversion and reversions, remainder and remainders, rents, and services of the said premises and of every part thereof and all the estate, right, title, interest, claim, and demand whatsoever of them, the said Catharine and Nicholas, of in and to the said messuage, tenement, and premises, and every part thereof. To have and to hold the said messuage or tenement and all and singular the said premises above-mentioned in every part thereof with the appurtenances unto the said Joseph Massey, his heirs, and assigns, to the only proper use and behoof of the said Joseph Massey, his heirs, and assigns, forever; and the said Catharine Massey and Nicholas Massey, for them and their heirs, the said messuage or tenement and premises every part thereof against them and their heirs and against all and every other person and persons whatsoever claiming by from or under them or any of them to the said Joseph Massey, his heirs, and assigns, shall and will warrant and forever defend by these presents. In witness whereof the parties to these presents have interchangeably set their hands and affixed their seals the day and year first above written.

Maryland Kent County to wit: Be it remembered that on this ninth day of October, Anno Domini seventeen hundred and sixty five, personally appeared before, us the subscribers, two of the right Hon. the Lord  proprietary's Justices of the Peace for the county aforesaid, the within Catharine Massey and Nicholas Massey and Henrietta his wife and did severally acknowledge the within indenture as their act and deed and the lands and tenements within mentioned to be the right and title of the within Joseph Massey, his heirs, and assigns, forever; and we further certify that we did privately examine the aforesaid Henrietta out of the hearing of her said husband for the taking of the acknowledgment and she did declare that she made the same freely and willingly without fear of or threats or ill usage from her said husband.
